1. Agreement to Terms
By creating an account or using our application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
RiskLync provides a lead intelligence platform for the insurance industry. The Service includes predictive lead scoring, identity resolution, real-time bid optimization, and campaign management tools. RiskLync integrates proprietary scoring models, third-party data enrichment APIs, and AI-assisted analysis to help insurance lead buyers and publishers make better acquisition decisions.
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. User Data
You retain all ownership rights to the data ("User Data") you upload to the Service, including lead records, disposition outcomes, and campaign configurations. You grant us a limited license to use, process, and transmit User Data as necessary to provide the Service to you, including scoring, identity resolution, and model training. You are solely responsible for the accuracy, legality, and appropriateness of the User Data you provide, including compliance with consent requirements for any personally identifiable information.
5. Prohibited Uses
You may not use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules, and regulations applicable to your use of the Service, including data privacy laws, CMS regulations, and TCPA requirements. You may not upload any data for which you do not have the proper authority or consent.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Lead scores, tier assignments, and conversion predictions are probabilistic estimates based on historical data and statistical models. You should not rely solely on scoring outputs for final financial commitments or bidding decisions. Actual conversion outcomes will vary based on lead source quality, agent performance, and market conditions.
8. Limitation of Liability
In no event shall RiskLync, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses, resulting from your use of the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect.
